1. Object and Acceptance

These Terms of Use ("Terms") govern the use of the SetAcademy SaaS platform ("the Platform", "the Service") accessible at app.setacademy.co.

SetAcademy is an educational management and online training platform that allows educational institutions, training centers, and independent trainers to create, manage, and monetize online courses, as well as manage their educational activities (scheduling, attendance, students, etc.).

By creating an account or using the Platform, you unconditionally accept these Terms. If you do not accept these conditions, please do not use our services.

2. Definitions

  • "SetAcademy", "we", "our" : refers to the publisher of the Platform
  • "User", "you", "your" : refers to any individual or legal entity using the Platform
  • "Account" : the User's personal space on the Platform
  • "Content" : any material, information, text, image, video, file uploaded or created on the Platform
  • "Course" : training, educational module, or resource created by the User
  • "Student" : person enrolled in a course via the Platform

3. Registration and User Account

3.1. Registration Conditions

To use the Platform, you must:

  • Be at least 18 years old or have authorization from a legal representative
  • Provide accurate, complete, and up-to-date information
  • Maintain the security of your account (strong password, two-factor authentication recommended)
  • Be responsible for all activities performed under your account

3.2. Account Types

  • Personal account: for independent trainers
  • Organization account: for businesses, training centers, and organizations (may include multiple users)

4. Service Description

SetAcademy offers the following features:

  • Creation and management of online courses
  • Student and enrollment management
  • Integrated payment system for course sales
  • Session scheduling (in-person and online)
  • Attendance management
  • Progress tracking and certifications
  • Multi-academy management
  • API for third-party integrations

5. User Obligations

5.1. Compliant Use

You agree to:

  • Use the Platform in accordance with its intended purpose and these Terms
  • Comply with applicable laws and regulations
  • Not use the Platform for illegal, fraudulent, or harmful purposes
  • Not attempt to gain unauthorized access to systems or data
  • Not disrupt or harm the operation of the Platform
  • Respect the intellectual property rights of SetAcademy and third parties

5.2. Published Content

You are solely responsible for the Content you publish on the Platform. You warrant that:

  • You have all necessary rights to the Content
  • The Content does not violate any third-party rights (intellectual property, image rights, etc.)
  • The Content is not illegal, defamatory, offensive, discriminatory, or contrary to public decency
  • The Content does not contain viruses, malware, or malicious code
  • The Content respects students' personal data (GDPR compliance)

6. Pricing and Payment

6.1. Subscription Plans

SetAcademy offers different subscription plans (Free, Starter, Business) with varying features and limits. Prices are indicated on our pricing page and may be modified with 30 days' notice.

6.2. Payment

  • Payments are made by credit card or bank transfer depending on the plan
  • Subscriptions are automatically renewed unless cancelled
  • Invoices are available in your user area
  • In case of payment failure, access may be suspended after notification

6.3. Commission on Sales

For courses sold via the Platform, a commission may be charged according to your plan (0% to 15%). This commission is deducted from the amount received by the User.

6.4. Refund

In accordance with applicable legislation, you have a 14-day right of withdrawal from the date of subscription. Beyond this period, no refund will be made except in exceptional cases at our discretion.

7. Intellectual Property

7.1. SetAcademy Rights

The Platform, its source code, design, features, and all elements that compose it are the exclusive property of SetAcademy and are protected by intellectual property laws. Any unauthorized reproduction, modification, or use is prohibited.

7.2. User Rights on Their Content

You retain all your intellectual property rights on the Content you create and publish on the Platform. By publishing Content, you grant SetAcademy a non-exclusive, worldwide, and royalty-free license to use, store, display, and distribute this Content in the context of providing the Service.

8. Data Protection

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

As an institution or trainer, you are responsible for processing your students' personal data. You must ensure compliance with applicable regulations (GDPR, etc.) and obtain necessary consents.

9. Availability and Maintenance

We strive to ensure maximum availability of the Platform. However:

  • Interruptions may occur for maintenance, updates, or force majeure
  • We do not guarantee 100% availability
  • We reserve the right to temporarily interrupt access for technical or security reasons
  • We will perform regular backups but cannot guarantee recovery of all data in case of loss

10. Limitation of Liability

SetAcademy is provided "as is". Within the limits permitted by law:

  • We do not guarantee that the Platform will meet all your specific needs
  • We are not liable for indirect damages (data loss, loss of revenue, etc.)
  • Our liability is limited to the amount of sums paid over the last 12 months
  • We are not responsible for Content published by Users
  • We are not responsible for disputes between Users and Students

11. Termination

11.1. Termination by User

You may terminate your account at any time from your account settings or by contacting us. Termination takes effect immediately or at the end of the current subscription period at your choice.

11.2. Termination by SetAcademy

We may suspend or terminate your account in case of:

  • Violation of these Terms
  • Fraudulent or illegal use of the Platform
  • Non-payment of amounts due
  • Prolonged inactivity (more than 12 months for paid accounts)

11.3. Consequences of Termination

In case of termination, your access to the Platform will be immediately suspended. You have 30 days to export your data. After this period, your data may be permanently deleted.

12. Modifications to the Terms

We reserve the right to modify these Terms at any time. Modifications take effect upon their publication on the Platform. In case of substantial modification, we will inform you by email or via a notification on the Platform.

Your continued use of the Platform after the publication of modifications constitutes acceptance of the new Terms.

13. Applicable Law and Jurisdiction

These Terms are governed by French law. In case of dispute, and after attempting amicable resolution, French courts shall have exclusive jurisdiction.

In accordance with European regulations, if you are a consumer residing in the EU, you also benefit from the mandatory consumer protection provisions of your country of residence.

14. General Provisions

  • If a provision of these Terms is declared invalid, the other provisions remain in effect
  • Failure to exercise a right does not constitute a waiver of that right
  • These Terms constitute the entire agreement between you and SetAcademy regarding the use of the Platform
